Terms of Use

These Terms of Use (“Terms”) are the legal agreement between you and Unbroken Games (“Unbroken Games” or “We”) and govern your use of the Services provided by Unbroken Games, including games that were created or published by Unbroken Games on websites, special services, stores, chat rooms, forums that belong to Unbroken Games (hereinafter

referred to as “Services”).

Using the Services, in completely or in part, downloading, and installing, registering, playing, getting access - you agree to these Terms of use. If you do not agree to these Terms, do not purchase or use the Services.

The Unbroken Games Privacy Policy also governs use of the Services. Our Terms and Privacy Policy affect your statutory rights and obligations. If you do not agree to these Terms or the Privacy Policy, you may not access or use the Unbroken Games Services.

STARTING TO USE THE SERVICE, YOU ACKNOWLEDGE THAT YOU HAVE READ THESE TERMS AND AGREE TO BE BOUND BY ITS PROVISIONS.

 

1. License and limitations.

In accordance with these Terms Unbroken Games gives you a non-exclusive, limited, revocable, non-transferable license to use the Service for your personal, non-commercial purposes.

 

You do not have the right to:

  • modify, translate, reverse engineer, reverse compile or decompile, disassemble, use any tools to collect and / or extract data from the Services;

  • reproduce, duplicate, copy, sell, resell or otherwise use the Services, in whole or in part, for any purpose without the written consent of Unbroken Games;

  • use any tools for data extraction or automation tools, such as spiders, scanners, scripts, bots or any other automated method of recording information;

  • use any meta tags or any other “hidden text” using the name of the company “Unbroken Games”, its games, Service, employees or partners without the written permission of Unbroken Games;

  • to take actions that may be illegal or malicious, including, but not limited to "breaking" games, services, violation of intellectual property rights or other proprietary rights Unbroken Games or third parties.

Attention! Unbroken Games grants you a non-exclusive, non-transferable, revocable, limited license to use our games and the Service, solely for your personal, non-commercial use on authorized devices, unless otherwise indicated. Game or Service may not be copied, resold or sublicensed. These Terms apply to all versions and product updates from Unbroken Games, including, without limitation, trial, and test, free and paid versions.

Games and any Services from Unbroken Games may include access control measures, including age control and distribution geography. In accordance with these Terms, it is strictly forbidden to unauthorized copying or other modification of the rights and licenses granted to you as a user. You cannot take any action to bypass or modify the security features.

 

You acknowledge and agree that you are solely responsible for your actions and those committed using your player account.

2. Third-party products and services.

Unbroken Games may offer third party services and products to you. You assume all risks and liabilities associated with the use of any such third-party products. Your rights and obligations when using such services and products will be governed by the relevant terms of use and privacy policies of third parties - the providers of such services.

Warning! Products and services of third parties may include hyperlinks to websites over which Unbroken Games has no control. Unbroken Games is not responsible for the availability of such external sites or resources and is not responsible for any content, advertising, products or other materials available on such third-party sites or resources.

3. Access and authorization.

Unbroken Games develops games that use in-game currency, and (but not necessarily) authorization is required to take part in the game (using an electronic mailbox or account in one of the social networks). Using the Services and Products of Unbroken Games, you confirm that you are 17 years old (or you have reached the age of majority if you are under 17), or that you have read these Terms with your parent or guardian, and they, in accordance with these Terms are fully responsible for enforcing them on your behalf. If you are under the age of 13, you must have permission from your parent or guardian to use the products and Services from Unbroken Games. Unbroken Games has the right to disconnect you at any time from the use of the Services and products if you do not have permission from your parents or guardian. You can find more information about the use of your personal data in the Unbroken Games Privacy Policy or the privacy policy of third parties whose products and services you use.

 

To use some services of Unbroken Games you need to register an account. Your account is unique and you cannot rent, lease, sell, exchange, donate, bequeath or otherwise alienate it to anyone else. You agree to provide true and complete information about yourself when registering your Account and updating it. You cannot have more than one Account or access the Services through multiple accounts at the same time.

 

Unbroken Games is not responsible for the conditions and cost of connecting your devices to the Internet, including when connected via the network of mobile operators.

 

Unbroken Games has the full right to cancel an account if it is inactive for more than 180 days.

4. Built-in purchases.

Using the products and services of Unbroken Games you can receive, buy, win or otherwise receive in-game currency (“Game Currency”) to access virtual, in-game digital goods (properties of this product) or items (“Virtual Items”). Ways of getting game currency are determined by Unbroken Games. Game currency and virtual items are not real money, have no cash value and can not be redeemed for legal currency.

In-game currency and Virtual Items are provided to you for a limited, personal, revocable, non-transferable, non-sublicensed license to use as part of the game from Unbroken Games. You may not have property rights to any Game currency or Virtual items that appear or are created in games and you cannot transfer, sell or otherwise alienate the Game currency or Virtual items to other players or third parties.

 

Attention! Unbroken Games is not responsible for the loss of your Game Currency or Virtual Items, including if your account is hacked. Unbroken Games is not obliged to and will not refund to you Game currency or virtual items obtained with the help of game currency. Unbroken Games reserves the right, at its sole discretion and without prior notice, to change the price, availability or quantity of Virtual Currency or Virtual Items available to order by you. Unbroken Games has the right to refuse to provide you with Game Currency or Virtual Items.

 

All in-game purchases are processed in the app store (for example, Google Play or iOS App Store). Please review the payment terms and privacy policies of these stores.

 

By accepting these Terms and Conditions, you unconditionally agree that all purchases of Game Currency or virtual items are final. Refund is not provided, except as required by the law of your country or as decided by the court.

 

5. Auto renewing subscription.

Subscription options

 

We have the following subscription periods in our game:

  1. Weekly premium access for $4.99;

  2. Monthly premium access for $8.99;

  3. Annual premium access for $99.99.

 

The 3-day free trial is available with monthly access only. Then the free trial is over, a payment will be automatically initiated for the next subscription period.

 

Premium Access offers provides Awards:

  1. increased daily rewards;

  2. increased the maximum amount of energy;

  3. more energy recovery at a time;

  4. more VIP points earned.

 

Then the subscription is over, a payment will be automatically initiated for the next subscription period.

 

This price is established for United States customers. Pricing in other countries may vary and actual charges may be converted to your local currency depending on the country of residence.

 

Payment will be charged to your iTunes Account or Google Play Account at confirmation of purchase. Subscription automatically renews unless auto-renew is turned off at least 24-hours before the end of the current period. Account will be charged for renewal within 24-hours prior to the end of the current period, and identify the cost of the renewal. Subscriptions may be managed by the user and auto-renewal may be turned off by going to the user's Account Settings after purchase. Any unused portion of a free trial period, if offered, will be forfeited when the user purchases a subscription to that publication, where applicable.

6. Use of sites, forums, chat rooms.

Some Services provided by Unbroken Games may include the ability to chat, specialized forums, communities, comment or participate in blogs, create, send, publish, copy, transmit, distribute links to content located on these resources (hereinafter referred to as “Communities").

 

Attention! You are solely and personally responsible for all content (message, links) that you post on these resources.

 

Communities cannot be used for commercial purposes. Unbroken Games has the right, but not the obligation, to monitor or delete the Content of the Community, which Unbroken Games considers harmful, offensive or otherwise violate these Terms. In case of violation of the terms of this agreement, your account may be blocked without the right of appeal or restoration.

7. Intellectual property.

All property rights, including intellectual property rights, belong to Unbroken Games Company and are protected by law. You may not use, copy, transfer, modify, distribute or create any derivative work from the Games, Services, Content of Unbroken Games without the prior written consent of Unbroken Games.

 

At the same time, Unbroken Games Services may allow you to create your own content (“Own Content”), which includes Unbroken Games content, including photos that include graphic design elements of the Services, or graphics from games, screenshots, video streaming or video your game. You accept and understand that you retain all rights to your Content, but provided that Unbroken Games has an exclusive, perpetual, irrevocable, fully transferable and sub-licensed worldwide right and license to your Content for any purpose, including, but not limited to, the rights to reproduction, copying, adapting, modifying, publishing or otherwise transmitting your content to the public. Except as prohibited by law, you waive any moral or material rights to the content that will be created by Unbroken Games using your content.

 

8. Disclaimer and disclaimer of warranty.

All services of the company Unbroken Games you use "as is".

 

Unbroken Games is not responsible for any damage that may be caused to you by using the Unbroken Games Services.

 

You acknowledge and agree that Unbroken Games assumes no responsibility and cannot be held responsible or guilty for any damage that may be caused to you by third parties, including other users of the Services, while using the Unbroken Games Services.

 

9. Indemnification.

You agree to prevent actions or omissions, which may entail any charge against Unbroken Games, its Services, its employees and owners, its partners, third parties who cooperate with Unbroken Games. You undertake to indemnify any damages, fines and expenses that may be applied to Unbroken Games or persons related to it, due to violations of your content on forums, websites, other platforms and platforms.

 

10. Termination of the use of the Services.

These Terms of Use may be terminated at any time on your part. The terms automatically expire if you do not violate any clause of the Terms. You have the full right to stop using the Services by deactivating your account. Unbroken Games have the right to terminate or cancel your Account in Services at any time for any reason and without prior notice.

 

After blocking (canceling) your account, you must immediately stop using the Services.
